These Terms of Service (Terms) apply to purchases made through the Twyn Active online store (Store). By browsing the Store, placing an order, or using any Store services, you agree to these Terms.

2. Eligibility and use of the Store

·         You must be at least 18 years old (or have permission from a parent/guardian) to place an order.

·         You agree to use the Store lawfully and not to interfere with Store security or functionality.

3. Products and information

·         We aim to display product colours, sizing, and details as accurately as possible. However, screens can display colours differently.

·         Product availability may change at any time. We may limit quantities per order.

4. Pricing and currency

·         All prices are shown in AUD unless stated otherwise.

·         Prices may change without notice. The price charged is the price shown at checkout.

·         Where applicable, prices include GST (or will be clearly stated).

5. Orders

·         When you place an order, you are making an offer to purchase.

·         We may accept or reject orders (for example, due to stock issues, suspected fraud, or pricing errors).

·         If we cancel an accepted order, we will refund you using your original payment method.

6. Payment

·         Payment must be received in full before we dispatch your order.

·         We use third-party payment providers. Your payment may be subject to the provider’s terms and privacy practices.

7. Shipping and delivery

·         Shipping costs and estimated delivery times are shown at checkout.

·         Delivery timeframes are estimates only and may be affected by factors outside our control.

·         Risk of loss passes to you once the order is delivered to the address provided.

8. Click and collect (if offered)

·         If Click and Collect is offered, collection instructions and timeframes will be provided at checkout.

·         You must bring proof of purchase/ID when collecting.

9. Returns, exchanges and refunds

Our Returns Policy forms part of these Terms.

·         If you believe an item is faulty, damaged, or not as described, contact us as soon as possible with your order number and photos.

·         For change-of-mind returns (if offered), items must be unworn, unwashed, and in original condition with tags attached.

·         Refunds (where approved) will be processed to the original payment method.

Australian Consumer Law: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

10. Promotions and discount codes

·         Discount codes must be applied at checkout and cannot be applied after an order is placed.

·         Unless stated otherwise, discount codes cannot be combined.

·         We may change or end promotions at any time.

11. Gift cards (if offered)

·         Gift cards are redeemable only at the Store and are not refundable.

·         Lost or stolen gift cards may not be replaced.

·         Any additional terms shown at purchase apply.

12. Intellectual property

·         All content on the Store (including logos, images, text, and designs) is owned by or licensed to Twyn Active.

·         You may not copy, reproduce, or use our content for commercial purposes without written permission.

13. User content (reviews, comments, photos)

If you submit content (including reviews or photos): - You confirm you have the right to share it. - You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display it for marketing and Store purposes. - We may remove content that is unlawful, misleading, or inappropriate.

14. Privacy

Our handling of personal information is described in our Privacy Policy. By using the Store, you consent to our collection and use of your information as described there.

15. Third-party links and services

The Store may contain links to third-party websites or services. We are not responsible for their content, availability, or practices.

16. Limitation of liability

To the maximum extent permitted by law: - We are not liable for indirect or consequential loss. - Our liability for any claim relating to goods is limited to (at our option) replacement, repair, or refund, as required by law.

Nothing in these Terms excludes rights you have under the Australian Consumer Law.

17. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control (including carrier delays, natural disasters, or service outages).

18. Changes to these Terms

We may update these Terms from time to time. The version posted on the Store at the time you place an order applies to that order.

19. Governing law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
